Resto Mojo – Terms of Service

1. Acceptance of Terms

By accessing or using the Resto Mojo mobile application, website, or related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. You must be at least 18 years old or the legal age of majority in your jurisdiction to use Resto Mojo.

2. Description of Service

Resto Mojo is a concierge-style service designed to help users request and manage restaurant reservations on their behalf. We may attempt to secure reservations using publicly available restaurant platforms such as Resy, OpenTable, or other third-party systems.

• Resto Mojo is not affiliated, endorsed, or partnered with any restaurant, dining platform, or reservation provider.
• Resto Mojo does not own, operate, or control any restaurant or third-party booking platform.
• Resto Mojo cannot guarantee availability of any reservation, table, or restaurant experience.

All restaurant interactions, policies, and payments are strictly between you and the restaurant.

3. Account Registration and Security

To use the Service, you may need to create an account. You agree to:

• Provide accurate and complete information.
• Maintain the confidentiality of your login credentials.
• Be responsible for all activity that occurs under your account.

We may suspend or terminate your access at any time if we suspect misuse or violation of these Terms.

4. User Responsibilities

You agree not to:

• Misuse the Service, including submitting fake or speculative reservations.
• Attempt to disrupt or overload the system.
• Use automated scripts or bots to interact with Resto Mojo.
• Circumvent any restrictions or abuse any queue or waitlist system.

You are solely responsible for ensuring that any reservation request you make complies with the restaurant’s terms, policies, and local laws.

5. Reservation Process

Resto Mojo acts only as an agent at your request to submit reservation attempts on your behalf. While we make reasonable efforts to secure your desired reservation, we do not guarantee that any reservation will be accepted, confirmed, or honored by a restaurant.

Once a reservation is confirmed, it is your responsibility to attend, modify, or cancel it according to the restaurant’s rules. Resto Mojo is not liable for any cancellations, errors, or no-shows by the restaurant or user.

6. Fees and Payments

Resto Mojo may charge fees for concierge or queue services (“Fees”). Fees will be disclosed prior to payment and may depend on the type of service or success of a reservation.

All payments are processed securely through third-party payment providers (e.g., Stripe). You authorize Resto Mojo to charge your payment method for applicable Fees.

Refund Policy: Fees are non-refundable, except as required by law or explicitly stated otherwise.

7. No Affiliation or Endorsement

Resto Mojo is not affiliated with Resy, OpenTable, or any restaurant. All trademarks, logos, and names are the property of their respective owners. Use of these platforms or references to them does not imply any partnership or endorsement.

8. Intellectual Property

All content, software, design, and branding of Resto Mojo are the exclusive property of Mazzanfar Labs LLC. You may not reproduce, modify, distribute, or create derivative works based on the Service without our written consent.

9. Third-Party Services

The Service may include links or integrations with third-party systems (e.g., Resy, OpenTable). Your use of those services is governed by their own terms and privacy policies. We do not control and are not responsible for any third-party content, actions, or data handling.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Resto Mojo disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We make no representations or guarantees about:

• Reservation availability or confirmation.
• The quality, safety, or legality of any restaurant or dining experience.
• The reliability or performance of third-party systems.

You use the Service at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Mazzanfar Labs LLC (doing business as Resto Mojo) and its affiliates, officers, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service.

In no event shall our total liability exceed the amount you paid to us (if any) in the three months preceding the claim. Some jurisdictions do not allow certain limitations of liability — in those cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mazzanfar Labs LLC, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or related to:

• Your use or misuse of the Service.
• Any violation of these Terms.
• Any interaction or dispute with a restaurant or third-party provider.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your account at our discretion if we believe you have violated these Terms or acted in a way that harms other users or the integrity of the Service. Upon termination, any outstanding Fees remain due.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles.

Any dispute or claim arising under these Terms shall be resolved through binding arbitration in Wyoming, in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version and update the “Effective Date.” Continued use of the Service after such updates constitutes your acceptance of the new Terms.
